1. Interpretation and Variation

In the Terms and Conditions the following definitions apply.

1.1   “Company means Blessed Yoga Limited. Company number 12022999.

1.2   “Member” means any person that has completed and submitted either the online registration form on the Blessed website or the Blessed app.

1.3  “Online” means any yoga class presented by a Blessed teacher that uses the internet as its means of communication to any Member or other person and/or any other analogous form of communication whether now known or created in the future. 

1.4   Studio” means blessed@thecowshed, Hatchers, Chichester Road, Sidlesham Common, Chichester, West Sussex, PO20 7PY 

1.5   Terms and Conditions” mean these terms and Conditions.

1.6   Reference in the Terms and Conditions to the singular will include the plural and vice versa and the reference to the masculine gender will include references to the feminine gender  

1.7   The Terms and Conditions are incorporated into the Registration Form

1.8   The Company reserves the right to vary and revoke any of the Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the governance of the Studio and the conduct of the Members. Any such changes will be published on our website and, until revoked, are and will be binding on Members.

1.9   The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

2. Membership

2.1   Subject to condition 2.2 when a person has purchased a yoga package or used the Studio products / facilities / services they shall become a Member of the Studio.

2.2   Acceptance of a person as a member or a studio user is at the discretion of the Company.

2.3   The Company reserves the right to withdraw, suspend or refuse to renew the membership of any member or user whose conduct is, or may be deemed to be in the Company’s reasonable opinion, injurious to the character of the Studio or amounts to a breach of the Terms and Conditions or where such expulsion is otherwise to be in the interests of the other Members of the Studio. Any Member so expelled shall forfeit all privileges to membership and shall not be entitled to any refund for any period during which his membership is suspended.

2.4   The Studio may run promotional introductory offers from time to time. These offers are exclusively for new Members who are not already registered with the Studio are not for repeat use.

3. Studio Opening Times

3.1   Details of class times at the Studio may vary from time to time. Class times will be published by the Studio on our website and App.

4. Payment Terms

4.1   Details of yoga packages are available on our website, through our App or shall be such prices as determined by the Company from time to time.

4.2   Payments for classes at the Studio do not entitle Members to attend classes at any yoga Studio other than those operated by this Company (in the event that they are available).

4.3   Subject to any statutory right of cancellation, payments for classes, class pass fess, monthly subscriptions fees and annual payments are non-refundable unless otherwise stated in the Terms and Conditions.

4.4   Workshops, Retreats and Programmes at Blessed Yoga Limited are non-refundable.

4.5   In the event of the Company cancelling a Workshop, Retreat or Programme we will refund Members all deposits and payments they have paid. We cannot however compensate Members for airfare or travel costs incurred. In the unlikely event that we must cancel a Workshop, Retreat or Programme due to a force majeure (including but not limited to; weather, natural disaster or political upheaval) we cannot guarantee a refund. To cover these risks, we highly recommend that Members purchase travel insurance.

4.6   If a service credit pack is bought and only part used there will be no refund available for the remaining classes.

4.7   Subject to any statutory right of cancellation, payments for all purchases made online or at the Studio are non-refundable unless otherwise stated in the Terms and Conditions.

5. Bookings and Cancellations

5.1   Classes cancelled up to 2 hours before the class starts will be refunded to your account in full. Failure to cancel your booking online at least 2 hours before the class starts or a no show will result in the loss of a credit or payment for that class. 

6. Intro Offer ( Auto-Conversion )

6.1   Upon purchase or use of the Studio’s New Student Intro Offer Members are agreeing automatically to be enrolled into a Monthly Unlimited Class Pass autopay contract. Termination is in agreement with clause

7. Subscription Autopay

7.1   he provisions of this clause 6 shall only apply to Members that subscribe to unlimited classes by monthly or yearly autopay “Subscription”.

7.2   Subscription fess must be paid in accordance with the Terms and Conditions irrespective of whether or not the Member uses the Studio’s facilities.

7.3   Members shall be given no less than 10 working days’ written notice of any increase in their Subscription fees.

7.4   If a member does not pay their Subscription for the Subscription Period (or cancels their Subscription during the Subscription Period) then the Company is entitled to charge the Member for any outstanding Subscriptions in respect of the Subscription Period.

7.5   Members agree and acknowledge that be agreeing to the Subscription Period, they are being given preferential rates by the Company and therefore it is fair and reasonable that the Company charges them for any payments as described and referred to in 6.4.

7.6   It is the sole responsibility of the Member to cancel their monthly autopay with their bank on termination of their subscription. The Company cannot be held liable for any payments processed due to failure of a Member to cancel their autopay.

7.7   Members who do not wish to accept a change proposed by the Company to the Terms and Conditions or to pay an increase in any Subscription fees may cancel their Subscription by giving written notice to the Studio. The notice must be given before or within 28 days after the change to the Terms and Conditions or increase in Subscription fees take effect and must expire at the end of the relevant calendar month. The Member giving notice must continue to pay subscriptions at the rate current immediately prior to any proposed increase until the end of such notice period. 

8. Personal Belongings

8.1   Personal belongings are brought into the Studio premises at the Member’s risk and the Company does not accept liability for any loss or damage whatsoever to such items.

9. Use Of Facilities

9.1   A Member is welcome to use the Studio’s facilities. The Studio may at any time withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or Company.

9.2   Children between the ages of 12 and 16 may only use the Studio and attend classes if accompanied by an adult and when under their care and supervision, however the Studio reserves the right of refusal for any minor to practice according to clause 7.1.

9.3   All children under the age of 16 years are the responsibility of the accompanying adult when in the Studio premises.

10. Fitness And Health

10.1   Members are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical conditions. The Studio reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such 

10.2   From time to time we may offer a mix of yoga and cardio class (Yoga Burn). This is a vigorous exercise programme that involves heart rate peaks alongside a traditional practice and Members of other persons with any concerns as to heart , pulmonary and/or circulatory issues should not participate. To those that do participate the advice is to listen to your body, and not to push yourself into a ‘distress’ situation where you find yourself  very short of breath or experience any other physical discomfort that concerns you. Finally all effort is taken to warm up properly but vigorous exercise patterns do place strain on muscles and tendons, and it is possible (although unlikely) for people to injure an Achilles tendon as it would be for any other active weight bearing sporting activity.

10.3   If you are under the age of 18 you need parental or guardian consent to participate in any of the Blessed Yoga Classes. It is a condition of your participation that you have that consent.

11. Dress And Footwear

11.1   Members are requested to wear clothes appropriate to the practice of yoga. Footwear should be removed on entry to the premises and left in the reception area.

12. Safety And Hygiene

12.1   Smoking is not allowed anywhere on the premises.

12.2   No crockery, glass or food is permitted in the Studio unless required for a training or workshop.

12.3   No pets, unless guide dogs, are permitted on the premises.

12.4   Members are requested not to walk around the Studio barefoot if they have foot complaints. Please wear yogi socks or flip flops.

12.5   Members must use the appointed entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these doors for any reason.

12.6   In the event of a fire, Members are asked to make their way to the nearest available exit.

13. General Guidelines

13.1   Members must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.

13.2   Members are required to give written notice to the Company of any changes of address, email or contact numbers. Failing such notice, all communication shall be assumed to have been received by the Member within 5 days of mailing to the last address notified to the Company.

13.3   The Company reserves the right to refuse admission to the Studio.

13.4   A person who is not a Member has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any terms of the Membership agreement or use any of the facilities provided by the Company.

13.5   The Company may, if a Member so wishes, communicate with the Member by email. By providing an email address to the Company, the Member consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Member also accepts any risks that email may not be a fully secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.

14. Limitation Of Liability

14.1   The Company cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the type of facilities provided, without notice and in its absolute discretion and the Company shall not be liable for any loss occasioned by such alterations except in so far as loss by law incapable of exclusion.

14.2   It is the Members responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme that they follow or class that they attend including without limit physical Studio or On-line classes. Members accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any programme or class. If in doubt ASK YOUR DOCTOR OR PHYSCIAN. The Company accepts no liability for loss or damage to property or injury of Members on the Studio premises or outside the Studio except in so far as such loss, damage, or injury is by law incapable of exclusion.
